BLUE DARWAZA TRAVEL PRIVATE LIMITED (PROJECT MEHRAULI) TERMS AND CONDITIONS

OVERVIEW

Please read these Terms and Conditions carefully as by booking any tour with Blue Darwaza Travel Private Limited, you acknowledge that you have read and understood these Terms and Conditions and you accept and agree to be bound by these Terms and Conditions. If you have confirmed a booking on any tour with more than one client named and booked on such a booking, you shall be deemed to have accepted these Terms and Conditions on behalf of all clients named in the booking (including minors and those with a disability) and therefore all clients in that group indicate their acceptance and agreement to these Terms and Conditions.

PRICING

Your confirmed proposal and/or Deposit Invoice will contain details of what is included in the price of your tour. Any items not detailed are not included in the price of the tour. We reserve the right to change our prices at any time before you book. If we do, you will be told of the revised price applicable to your booking before you commit yourself. Thereafter the price of your travel arrangements is subject to surcharges on the following items for increases in: transportation costs, security charges, government-imposed increases and other costs imposed by third parties.

RESERVATIONS AND PAYMENT

The total amount has to be paid at the time of the request in order to secure confirmation. Payment may be made by wire transfer or by any major credit card acceptable to us. Blue Darwaza Travel Private Limited is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the client as a result of credit card or other payment transactions in connection with the purchase of a tour.

CHANGES OR CANCELLATIONS MADE BY YOU

Should you wish to cancel or change your confirmed booking, the Party Leader must notify Blue Darwaza Travel Private Limited in writing. The following charges will apply from the date on which written notification is received by Blue Darwaza Travel Private Limited to compensate Blue Darwaza Travel Private Limited for its estimated losses and expenses.

  • Changes more than 48 hours in advance of the tour - You may change your tour, subject to availability, 48 hours before the start. If changes cannot be accommodated, there will be a full refund except for any non-refundable expenses (see below).
  • Changes less than 48 hours in advance of the tour - Changes within 48 hours of the start of the tour cannot be guaranteed, even if there is availability. If changes cannot be accommodated, there will NOT be any refund.
  • Cancellations more than 48 hours in advance of the tour - A full refund (less any non-refundable expenses- see below) will be given to you if you let us know more than 48 hours before the start of the tour.
  • Cancellations less than 48 hours in advance of the tour – No refund will be provided if you cancel the tour within 48 hours of the start of the tour.

If you cancel/change a tour, if we have incurred expenses which we can’t recoup (such as car hire), then you will have to pay for these expenses.

The tour starts at the designated time. If you arrive late for whatever reason and miss the tour, then no money will be refunded.

Traveler substitutions are considered as cancellations of reservations and are subject to the above cancellation fees. After the trip commences, we are unable to refund any amount for unused services (may include but not limited to hotels, air or train tickets, meals, admission fees) for any reason, such as your early departure, late arrival, or missed days on tours.

Cancellation of airfare, other transit, and lodging are further subject to the policies of the individual carriers or providers and may be in addition to the above fees. Additional cancellation fees are the responsibility of the traveler.

CANCELLATION OR SUBSTITUTION BY BLUE DARWAZA TRAVEL PRIVATE LIMITED

While everything will be done to provide the travel arrangements as confirmed to you, Blue Darwaza Travel Private Limited may occasionally have to change your tour arrangements or parts of them. Blue Darwaza Travel Private Limited reserves the right to do so. Most alterations are minor and should not affect the overall enjoyment of your tour. In the case of minor alterations, we will do our best to notify you before departure.

Total cancellation may be necessary in exceptional circumstances and Blue Darwaza Travel Private Limited reserves the right in its absolute discretion to cancel your entire travel arrangements. If this occurs before the agreed date of departure for reasons not arising from Force Majeure or the fault or negligence of or within the reasonable control of the client (i.e., due solely to the fault of Blue Darwaza Travel Private Limited), you will be offered the choice of an alternative tour of comparable standard (if available) or a full and prompt refund of all monies you have paid.

FORCE MAJEURE

Except where otherwise expressly stated in these Terms & Conditions, Blue Darwaza Travel Private Limited cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by, or you otherwise suffer any damage or loss as a result of, “Force Majeure”. In these Terms & Conditions, “Force Majeure” means any event or circumstances which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events or circumstances may include but are not limited to, (actual or threatened) war, riot, civil strife, terrorist activity, industrial dispute, technical problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions and level of water in rivers. Advice from the Foreign Office to avoid or leave a particular country may also constitute Force Majeure.

THIRD PARTY SUPPLIERS

We act only in the capacity of agent for the suppliers of the travel services named in your confirmation or itinerary or otherwise providing services or goods in connection with the Tour (the “Suppliers”), such as airlines, hotels and other lodging providers, local hosts, sightseeing tour operators, bus lines, car rental companies, driving services, restaurants, and providers of entertainment. We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, overbooking, default, strikes, or irregularity which may be occasioned by reason of any act or omission of any of the Suppliers or airlines providing flights to or from your Tour.

Suppliers have their own booking conditions or conditions of carriage, and these conditions are binding between you and the Supplier. Some of these conditions may limit or remove the relevant transport provider’s or other Supplier’s liability to you. You may be able to get copies of such conditions from our office, or from the offices of the relevant Supplier.

Certain providers or operators of certain activities will ask you to sign an indemnity waiver form. Broadly speaking, these explain the risks to you and indemnify them against claims by you. If you are not willing to comply, they will in certain circumstances not allow you to stay or take part in the activity. By accepting the terms of this Blue Darwaza Travel Private Limited agreement you accept that you will sign such indemnities.

TRAVEL INSURANCE

Travel insurance is NOT included in the tour price. We strongly recommend that you purchase trip cancellation and medical insurance. Any questions about what travel insurance does or does not cover should be addressed directly to the travel insurance company. If you decline insurance coverage, you will personally assume full responsibility for any financial loss associated with your travel arrangements, and you could lose your travel investment and/or have to pay more money to correct the situation.

LIMITATION OF LIABILITY

Please be aware that during your participation in a tour with Blue Darwaza Travel Private Limited, certain risks and dangers may arise including, but not limited to, the hazards of traveling in undeveloped areas, travel by boat, train, automobile, aircraft or other means of conveyance, the forces of nature, wild animals, war or military action, equipment failure, political unrest, accident or illness in remote regions without means of rapid evacuation or medical facilities, extortion, kidnapping, terrorism, Tour activities that may involve increased risks, dangers and risks inherent in activities in underdeveloped countries, and dangers of local law enforcement activity. Also be aware and clearly understand that Blue Darwaza Travel Private Limited and its agents and suppliers will not have liability regarding provision of medical care or the adequacy of any care that may be rendered.

You are voluntarily participating in these activities with the knowledge of the dangers involved and you agree to accept any risks. AS LAWFUL CONSIDERATION for the agreement with Blue Darwaza Travel Private Limited to participate in such trips and activities you hereby agree that you will not make a claim against Blue Darwaza Travel Private Limited, or its agents or employees, or sue for bodily injury, emotional trauma, death and/or property damage, however caused, as a result of your participation in a tour. You therefore release Blue Darwaza Travel Private Limited and its agents and employees from any and all claims, known or unknown, arising from your participation in a tour. You expressly waive any claim for consequential, special or incidental damages arising out of your activities in connection with the transactions contemplated by this Agreement.

MEDICAL PROXY

In the event that you are injured or become ill, or your child/ward/dependent is injured or becomes ill, and you and your spouse become unconscious or otherwise unable to give consent to medical care for yourself, spouse, or child/ward/dependent, as applicable, you hereby authorize Blue Darwaza Travel Private Limited and its employees, volunteers, agents and representatives, to obtain or consent to, for you, your spouse, or, as applicable, your child/ward/dependent, medical care (including, by way of example, first-responders medical treatment; X-Ray examinations; anesthetic, dental, medical or diagnosis and treatment; and hospital care) deemed necessary or advisable by Blue Darwaza Travel Private Limited. In addition, any medical provider is authorized to surrender physical custody of your child/ward/dependent to Blue Darwaza Travel Private Limited if you or your spouse is unable to take custody upon his/her release from medical care.

ACTIVE ELEMENTS, MEDICAL CONDITIONS, AND SPECIAL ASSISTANCE

Our tours are active and most require a reasonable level of mobility. Few locations we visit have wheelchair access. Clients are responsible for assessing their own suitability and capability to participate in a tour with us. All clients should consult their physician regarding their fitness for taking part in the booked tour. Blue Darwaza Travel Private Limited recommends all clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the entirety of the client’s travel with Blue Darwaza Travel Private Limited.

We will make reasonable efforts to accommodate the needs of our travelers; however, travelers needing special assistance for their personal needs must notify us at the time of booking for a determination of what assistance we can reasonably provide. In cases where we cannot accommodate a traveler’s special needs, persons requiring this assistance must be accompanied by a companion who will be responsible for independently providing the needed assistance. We regret that we cannot provide special individual assistance to travelers with special needs.

CONDUCT DURING THE TOUR

You are responsible for respecting the authority and following the directions of the tour guide and the laws of the countries in your itinerary during a tour. Blue Darwaza Travel Private Limited may refuse to carry a person whose behavior is detrimental to the enjoyment of the group. By travelling with Blue Darwaza Travel Private Limited, you agree to accept the authority of the guide and accept their decisions. Staff members are entitled to a safe working environment and our passengers to a great travel experience. Any threats to safety, being physical or verbal, or inappropriate behavior may result in removal from the trip. If a guide in its sole determination, requires a passenger to leave the trip, no refunds will be given and that passenger will be responsible for their own travel costs and arrangements from that point.

PASSPORTS AND VISAS

You are solely responsible for complying with passport and visa requirements. For U.S. travelers, international travel requires a passport valid six (6) months beyond your intended return travel date. In many cases, you will also need to have multiple consecutive blank visa pages within your passport (the number varies depending on the destination(s)). Many destinations also require that visas be obtained prior to travel. It is recommended that you check with the U.S. Department of State website for the latest passport and visa requirements.

We do not accept any responsibility if you cannot travel, or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.

RELEASE OF PICTURES FOR USE

You hereby consent to the use of pictures or video of you in Blue Darwaza Travel Private Limited marketing materials without compensation.

TRAVEL ADVISORIES AND WARNINGS

It is your responsibility to become informed about the most current travel advisories and warnings by referring to the U.S. State Department’s travel website at travel.state.gov.

COMPLAINTS

If you have cause for complaint while on tour, this must be brought to the attention of Blue Darwaza Travel Private Limited’s local appointed representative/agent or the hotel management or other Supplier immediately so that action can be taken to remedy the problem. Should your representative/agent or the hotel management be unable to resolve the problem, please contact Blue Darwaza Travel Private Limited immediately. If the problem is still unresolved, you must notify Blue Darwaza Travel Private Limited in writing about the details of the complaint within 28 days after the end of the tour.
